This Privacy Policy describes how Fenn AI LLC (“Company,” “we,” “us,” “our”) collects, uses, and discloses information when you use Fenn (the “App” or “Service”), and explains your privacy rights.

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

Interpretation

Words with capitalized initial letters have meanings defined under the following conditions. The definitions below apply regardless of whether terms appear in singular or plural form.

For the purposes of this Privacy Policy:

  • Account means a unique account created for you to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.
  • Application or App refers to Fenn, the software program provided by the Company.

  • Device means any device that can access the Service, such as a computer, cellphone, or digital tablet.

This includes third-party companies or individuals employed by the Company to facilitate the Service, provide the Service on behalf of the Company, perform services related to the Service, or assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

  • Phone number (used for account creation and authentication via one-time passcode)
  • Display name and profile information you choose to provide
  • Message content and other communications you send through the Service

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as your device’s Internet Protocol (IP) address, device type, mobile device unique identifiers, mobile operating system, the type of mobile internet browser you use, the features of our Service that you use, the time and date of your use, the time spent on those features, and other diagnostic data.

Information Collected while Using the Application

While using our Application, in order to provide features of our Service, we may collect, with your prior permission:

Contacts

With your permission, the App accesses the contacts stored on your device to enable contact-join notifications and to help you find people you know who also use Fenn. We do not upload, store, or transmit the phone numbers, names, or other contact details from your address book in plaintext.

Instead, phone numbers from your contacts are converted on your device into salted cryptographic hashes, which are transmitted to our servers solely to check for matches against other Fenn users. We do not retain hashes that do not match a Fenn user, and we do not use this data for advertising, marketing, or sale to third parties.

You can revoke contacts access at any time through your device settings.

Location

With your permission, the App collects your device’s location, including in the background if you grant that permission, to provide core coordination features such as arrival and departure detection and presence signals shared with people you have explicitly chosen to share with.

Location data is processed to derive human-readable status signals (for example, “at home” or “on the way”) and is shared only with the specific users you have authorized to receive it. We do not sell your location data or use it for advertising.

You can revoke or modify location access at any time through your device settings.

Calendar

With your permission, the App accesses your device calendar to detect scheduling intent in conversations and assist with coordination among the people you communicate with through the Service. Calendar event data is processed to identify potential events to coordinate around and to surface relevant suggestions within the App.

Photos and Camera

With your permission, the App may access your device’s camera and photo library so that you can share images within conversations and customize your profile. This information may be uploaded to the Company’s servers or to a Service Provider’s server, or it may be stored only on your device, depending on how you use the feature.

Notifications

With your permission, the App sends push notifications to inform you of activity relevant to your account, such as new messages, contact-join events, and coordination updates. You can disable notifications at any time through your device settings.

AI Processing

The Service uses AI models to analyze conversation content, calendar events, and location patterns in order to surface coordination suggestions and power core features of the App.

To provide these features, message content and related context may be transmitted to third-party AI model providers acting as our Service Providers under contractual confidentiality and data-handling obligations. These providers do not use your data to train their models. We do not sell your data or use it for advertising.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including monitoring usage of our Service.
  • To manage your Account, including managing your registration as a user of the Service. The Personal Data you provide can give you access to different functionalities of the Service that are available to you as a registered user.
  • To enable coordination features, including processing messages, calendar events, location, and contacts to provide the core functionality of the App.
  • To contact you by phone, SMS, push notification, or other equivalent forms of electronic communication regarding updates or informative communications related to the functionalities of the Service, including security updates, when necessary or reasonable for their implementation.
  • To manage your requests, including responding to support inquiries.
  • For business transfers: We may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.
  • For other purposes such as data analysis, identifying usage trends, and evaluating and improving our Service.

We do not sell your Personal Data, and we do not use your Personal Data for third-party advertising.

Sharing of Your Personal Data

We may share your personal information in the following situations:

  • With Service Providers: We share information with Service Providers to operate the Service, including hosting providers, AI model providers, analytics providers, and communication infrastructure providers, each bound by appropriate confidentiality and data-handling obligations.
  • With other users: When you send a message, share location, or otherwise communicate through the Service, the relevant information is shared with the recipients you have selected.
  • For business transfers: We may share or transfer your information in connection with a merger, sale of Company assets, financing, or acquisition.
  • With Affiliates: We may share your information with our Affiliates, in which case we will require those Affiliates to honor this Privacy Policy.
  • With your consent: We may disclose your information for any other purpose with your consent.

Retention of Your Personal Data

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy, including legal, accounting, or reporting requirements.

Message content is retained while your account is active so that the Service can function as intended. When you delete your account, your Personal Data is deleted from our active systems within a reasonable period, except where retention is required for legal or security purposes.

Usage Data is generally retained for a shorter period, except when used to improve security or functionality of the Service, or when legally required to be retained for longer.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. This means that your information may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where data protection laws may differ from those in your jurisdiction.

If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there.

Delete Your Personal Data

You have the right to delete or request assistance in deleting your Personal Data.

You may delete your account through the App’s settings, or you may contact us directly to request deletion. We may retain certain information if required by law or for legitimate business purposes such as fraud prevention.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition, or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement

Under certain circumstances, the Company may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.

Our Service is intended for users who are at least 18 years old. We do not knowingly collect Personal Data from anyone under the age of 18.
